Terms of Service
1. Who this agreement is between
These Terms are an agreement between RapidHQ (ABN 25 862 736 953), the operator of RapidQA, and the company or individual using RapidQA ("you", "your company"). By creating an account or using RapidQA, you agree to these Terms on behalf of your company.
2. What RapidQA is
RapidQA is a digital quality assurance record-keeping platform for construction and related trades. It allows your team to complete inspection checklists on site, automatically generate formatted PDF reports, track non-conformances, and manage approval workflows such as hold and witness points.
RapidQA is a tool for creating, storing, and communicating quality records. It does not perform engineering assessments, does not verify the technical accuracy of anything entered into it, and does not replace the professional judgement of qualified personnel. Your company remains fully responsible for the accuracy of the information recorded and for complying with all applicable engineering, safety, and regulatory obligations independent of RapidQA.
3. Accounts
Each person using RapidQA does so through an individual account — either an admin account (project setup, oversight, reporting) or a worker account (completing forms on site). You're responsible for:
- keeping login credentials confidential and not sharing individual accounts between people;
- the accuracy of information your team enters into the platform;
- promptly deactivating accounts for people who leave your company or no longer need access.
4. Subscriptions and payment
RapidQA is offered on a subscription basis, billed monthly, with plans tiered by the number of active projects. Pricing for each tier is set out at rapidqa.com.au and may be updated from time to time — we'll give you reasonable notice before any change affects your existing subscription.
Where a free trial period is offered, it will be agreed in writing (including by email) and will specify its length and what happens at the end of it. Subscriptions otherwise renew automatically each billing period until cancelled.
5. Your data
You own the data your company puts into RapidQA — project records, form submissions, photos, signatures, and everything else your team creates. RapidHQ stores and processes this data to provide the service to you; we don't use it for any other purpose, and we don't sell it. See our Privacy Policy for how personal information specifically is handled.
If your subscription ends, you can request an export of your company's records. We'll work with you to get your data out in a usable format within a reasonable time.
6. Acceptable use
RapidQA is provided for legitimate business quality-assurance purposes. You agree not to use it to store or transmit unlawful content, attempt to gain unauthorised access to other companies' data or the platform's underlying systems, or interfere with the platform's normal operation.
7. Availability and support
We aim to keep RapidQA available and working reliably, and to respond promptly to issues raised. As with any software service, we can't guarantee uninterrupted availability, and RapidQA — like any actively developed product — may occasionally have bugs or require maintenance. We'll work in good faith to resolve issues as they're identified.
8. Liability
To the maximum extent permitted by law, RapidHQ's liability for any claim arising from your use of RapidQA is limited to the fees you've paid for the service in the three months preceding the claim. RapidHQ is not liable for indirect or consequential losses, or for decisions made based on records created in RapidQA — the accuracy and adequacy of quality records, and compliance with applicable engineering and safety standards, remain your company's responsibility.
Nothing in these Terms excludes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Intellectual property
RapidHQ owns RapidQA — the software, design, and underlying platform. Nothing in these Terms transfers any of that to you. You retain ownership of your own data, as set out in section 5.
10. Ending the agreement
You can cancel your subscription at any time. RapidHQ may suspend or end an account for non-payment, misuse of the platform, or a serious breach of these Terms, and will make reasonable efforts to give you notice and an opportunity to resolve the issue first, except where immediate action is genuinely necessary.
11. Changes to these Terms
We may update these Terms from time to time, most often to reflect new features or clarify existing wording. We'll let you know of any material change before it takes effect.
12. Governing law
These Terms are governed by the laws of Queensland, Australia.
